Sexual Assault Sidelined on NY Campuses
Across the country more than 200 colleges and universities are under investigation for violations for Title IX and New York has more schools on that list than any other state.
These complaints allege violations to students’ rights under federal law, including Title IX. Under Title IX schools are required to respond promptly and effectively to reports of sexual assault, investigate possible incidents of sexual assault and take appropriate steps to address it and ensure survivors are safe, even while an investigation in ongoing. According to the federal government “a criminal investigation into allegations of sexual violence does not relieve a school of its duty under Title IX to resolve reports promptly and effectively.”
Despite the ridiculously high amount of schools requiring investigation, the DOE is cutting funding to the investigation of civil rights violations. Betsy DeVos is even spending just as much time talking to perpetrators of sexual assault and “men’s rights” hate groups about how to protect them rather than prioritizing the survivors of the crime themselves! Gross.
Thankfully, 18 states are suing DeVos. The lawsuits are for an entirely different reason, but it opens up the possibility for states to sue DeVos and the DoE for failing to investigate schools for Title IX violations, if/when the time comes.
